Plain-English terms that govern how you use this site and how Fishhook Marketing engagements work.

These Terms of Use ("Terms") cover your use of fishhookmarketing.com and any engagement you start with Fishhook Marketing, a DBA of Business Growth Partners, LLC ("Fishhook," "we," "us," "our"). By using this site you agree to these Terms. If you don't, don't use the site.
What we do
Fishhook is a digital marketing practice based in St. Petersburg, FL. We provide web design and development, search engine optimization (SEO), customer relationship management (CRM) implementation, marketing automation, AI consulting, and related services. Specific deliverables, scope, fees, and timelines for paid client work are set out in a separate engagement agreement (a written proposal, statement of work, or service order) between you and Fishhook. If the engagement agreement conflicts with these Terms, the engagement agreement controls for that engagement.
Using the site
You may use this site for lawful personal and business research. You may not:
- Scrape, copy, or republish substantial portions of the site for commercial purposes without our written permission.
- Attempt to access non-public areas of the site, interfere with site operation, or circumvent any security measure.
- Use the site or the contact channels to send unsolicited marketing, malware, or spam.
Bookings, payments, and the AI Assessment
Discovery calls are booked through a third-party scheduling tool (GoHighLevel). Booking a call doesn't create a binding engagement; we confirm scope and pricing in writing before any paid work begins.
The AI Assessment is offered in staged pricing tiers ("Founding Cohort"). Current pricing is displayed on the assessment page and locks in at the rate shown when you book. Paid tiers are processed through Stripe; you authorize Stripe to charge the payment method you provide.
Refunds. Refunds are handled case by case. If you're not satisfied with a paid assessment, contact us at contact@fishhookmarketing.com and we'll work it out.
No guaranteed results
Search engine rankings, lead volume, conversion rates, advertising performance, and AI tool outcomes depend on factors outside our control, including third-party algorithms, your market, your team's follow-through, and the time horizon involved. Fishhook does not guarantee any specific ranking, position, traffic level, lead count, revenue figure, or other quantitative result. Recommendations and forecasts we provide are our professional opinion based on the information available at the time, not promises.
Intellectual property
The Fishhook name, the Fishhook logo, the design language used on this site, and the original content (copy, photography we commissioned, and proprietary frameworks) are owned by Fishhook or used under license. Third-party trademarks, software, and content referenced on the site belong to their respective owners.
For paid client engagements, final deliverables (the production site, configured systems, documented automations, written reports) transfer to you on full payment, per the terms of the engagement agreement. Our internal templates, frameworks, working files, and AI prompts remain ours.
Confidentiality
Information you share with us during a discovery call or in the course of an engagement that a reasonable person would treat as confidential (financials, customer lists, strategic plans, internal process) stays confidential. We extend the same treatment to information we share with you about our own business. Information becomes non-confidential if it's already public, you publish it, or we receive it independently from another source.
Third-party services
The site links to and integrates with third-party services (including Stripe, Google Analytics, and the CRM, scheduling, and email tools listed in the Privacy Policy). Those services have their own terms and privacy policies. We don't control them, and using them means you accept their terms in addition to ours.
Disclaimers
The site is provided "as is" and "as available." We make no warranty, express or implied, that the site will be uninterrupted, error-free, or virus-free. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Fishhook, its principals, and its team will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost profits, revenue, data, or business opportunities, arising out of or in connection with your use of the site or any engagement. Our total cumulative liability for any claim arising out of or related to a paid engagement is capped at the fees you paid us for that engagement in the twelve months preceding the claim.
Indemnification
If your use of the site, or the materials you provide us during an engagement, causes a third-party claim against us (for example, if you supply copy or images you didn't have the right to use), you agree to defend, indemnify, and hold harmless Fishhook from that claim, including reasonable attorneys' fees.
Governing law and disputes
These Terms and any engagement are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. The state and federal courts located in Pinellas County, Florida have exclusive jurisdiction over any dispute arising out of these Terms or your engagement with us, and you consent to that jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be highlighted on this page; continued use of the site after a change means you accept the updated Terms.
